Terms & Conditions - Free ATA Promotion

These are the Terms and Conditions of the Freshtel $0 ATA offer.

Under this special offer a customer can receive one Freshtel 3010 ATA (Internet Telephone Adapter) at no charge or a bonus $129.95 worth of calls when purchasing Freshtel 3010 ATA in one of participating retail stores provided the customer agrees to commit to a 12-month agreement for Freshtel internet phone services on a $9.95 plan or greater. By participating in this promotion you are agreeing to pay the monthly charge plus any call costs that you might incur on Freshtel internet phone service during the term of the agreement.

Offer Validity

This offer is available on orders/purchases made between 1st March 2007 and 31st December 2007, unless it is extended by Freshtel. The 12-month contract period applies from the date the service is activated.

By accepting a Freshtel 3010 ATA and entering into a 12-month agreement you acknowledge that the device will be locked to the Freshtel internet phone service for a period of 12 months from the date the service is activated.

The offer is valid on orders made directly to Freshtel and selected retailers throughout Australia. It may not be used in conjunction with any other offer.

By accepting this offer you automatically agree to the Terms & Conditions of this offer, including the returns policy.

Contract Terms

To receive a Freshtel 3010 ATA at no charge or a bonus $129.95 worth of calls if you purchase Freshtel 3010 ATA in a retail store you agree to commit to a 12-month agreement with Freshtel by subscribing to the Freshtel $9.95 per month plan (or other higher cost plan). You are able to change to other plans that are offered during the contract period provided the value of the plan is not less than $9.95 per month. Your minimum commitment over the 12-month contract period is $119.40 ($9.95 x 12 months) plus call charges.

You agree with Freshtel Pty Ltd (ACN: 101 908 472) the terms and conditions herein.

Termination

The termination cost is based on the full price of the Freshtel ATA ($129.95) and calculated on the number of months the service has been active. Therefore if you wish to terminate your Freshtel service and stop paying the minimum monthly plan charge before the end of your 12-month agreement, you will incur the following charges:

  1. A termination fee of $50;
  2. All outstanding call charges;
  3. The remaining monthly charges on the contract. For example if you are on the $9.95 plan and you have 6 months to go on the contract this fee will be $59.70 = $9.95 x 6; and
  4. A pro rata calculation on the $129.95 RRP (recommended retail price) for the Freshtel 3010 ATA (Internet Telephone Adapter). For example if you have 6 months to go on the contract this fee will be $64.98 = $129.95 x 6 / 12.

After 12 months from the date of activation you can unlock the device by emailing us at info@freshtel.net.

14 day money back guarantee

A customer who has purchased a Freshtel 3010 ATA from Freshtel has the right to return the device to Freshtel within 14 days from the date of activation. Freshtel will waive any termination fee upon receipt of the ATA. If you wish to return the device under the 14 day money back guarantee, Freshtel will gladly refund the original price in accordance with the following criteria:

  1. For ATAs purchased in participating retail stores the store return policy applies and the unit cannot be returned to Freshtel.
  2. You must notify Freshtel within 14 days of purchasing the item and then arrange return of the item to Freshtel within 14 days of notification.
  3. You must provide a "proof of purchase", being either an invoice or email confirmation from Freshtel, or delivery note.
  4. Refunds can only be credited back to the credit card that was used to make the original purchase. The refund will be processed as soon as the item has been received and inspected by Freshtel, however, please allow 14 days from the day you return the item for your credit card account to be credited.
  5. The returned item must be in the original condition of sale and this includes the packaging. If this is not the case there will be no refund.
  6. You will need you to pay the return postage cost to us. We do NOT reimburse postage for the return of the device nder the 14 day return offer.
  7. Please note: Items purchased at a retail department store cannot be returned through Freshtel or the Freshtel online store under the 14 day return offer. This includes JB Hi-Fi, Clive Peeters, Clive Anthonys, Officeworks or any of Freshtel's retail partners.
  8. Please note: Returns of purchases made from the Freshtel online store may not be made to a Freshtel retail partner. This includes JB Hi-Fi, Clive Peeters, Clive Anthonys, Officeworks or any of Freshtel's retail partners.
  9. The customer will be responsible for any charges incurred from phone calls on their account during and after the 14 day period.

Returns Policy for Faulty Items

If you wish to return or exchange a faulty Freshtel 3010 ATA, Freshtel will gladly exchange or refund the original price in accordance with the following criteria:

  1. You must provide a "proof of purchase", being either an invoice or email confirmation from Freshtel, or delivery note.
  2. If device is faulty then the device will be replaced at no cost to the customer for the 12 month term of the manufacturer's warranty.
  3. Any customer wishing to return a faulty device must call Freshtel customer care and log the call to verify the device is actually faulty.
  4. Refunds can only be credited back to the credit card that was used to make the original purchase. The refund will be processed as soon as the items have been received and inspected by Freshtel, however, please allow 14 days from the day you return the item for your credit card account to be credited.
  5. If you wish to exchange your item, please make your request clear when contacting Freshtel customer care.
  6. Please note: Faulty items purchased at retail department store can be returned through Freshtel customer care.
  7. Please note: Returns of purchases made from the Freshtel online store may not be made to a Freshtel retail partner. This includes JB Hi-Fi, Clive Peeters, Clive Anthonys, Officeworks or any of Freshtel's retail partners.
  8. The customer will be responsible for any charges incurred from phone calls at all times.

Technical Specifications

You are advised that an Ethernet Router is required, or a Broadband Modem with at least one free Ethernet port. The minimum service required to enable a professional quality of service on the Freshtel internet phone network is a broadband internet connection of 512k/128k or better may be required depending on your distance from the telephone exchange.

Freshtel advises that Freshtel 3010 ATA (Internet Telephone Adapter) operates to provide an internet phone service with most compatible Ethernet Broadband Modem Routers. Freshtel accepts no responsibility for the customer's use of non-compatible Ethernet Broadband Modem Routers.

Call Credit Claim

$129.95 call credit means the customer does not pay for the first $129.95 worth of calls they make during the contract term. To claim the $129.95 call credit after purchasing the 3010 ATA in a retail partner's store the customer must send the original proof of purchase receipt and a completed Free ATA Promotion Call Credit Claim Form to the Freshtel customer care team.
